FCA Publishes Guidance on How the UK Crypto Regime Applies to Firms

The United Kingdom’s Financial Conduct Authority (FCA) on 16 September published cryptoasset perimeter guidance explaining how the country’s future crypto regime will apply to firms and which activities will require authorisation. The regime comes into force on 25 October 2027, while the authorisation gateway opens on 30 September 2026, giving firms about two weeks to understand the new perimeter before applications begin.

What the guidance covers

The guidance sets out which crypto activities fall inside the regulatory perimeter. These include issuing qualifying stablecoins, operating cryptoasset trading platforms, dealing and arranging deals, safeguarding cryptoassets, and arranging cryptoasset staking. Firms undertaking any of these activities will need to determine whether they require FCA authorisation once the regime applies, spanning custody and delegation risks around customer assets.

The publication follows the FCA finalising its rules and guidance in June 2026 and legislation passed in February 2026 that brought cryptoassets into UK regulation. The government has since made targeted changes to the law, adding limited exclusions and clarifying the position of certain technical services providers.

Authorisation timeline and next steps

Applications for authorisation open on 30 September 2026, and the regime becomes effective on 25 October 2027. The FCA is offering pre-application support meetings and webinars to help firms prepare. In October it will consult on targeted updates covering UK qualifying stablecoins, proprietary trading and market making, certain technology providers, decentralised protocols, and safeguarding arrangements, so parts of the perimeter could still evolve before the regime takes effect.

David Geale, the FCA’s executive director of consumers, payments and competition, said: “We are building a crypto regime that firms, consumers and international partners can trust. Getting ready for regulation starts with understanding how the regime applies to your business. This guidance gives firms the clarity they’ve asked for so they can prepare with confidence.”

What it means for firms

The guidance arrives as the UK regulator accelerates its crypto agenda. The FCA earlier opened a call for input on tokenised gold for UK wholesale markets, and the broader UK crypto framework has been taking shape since the February legislation. Crypto firms operating in the UK should review the perimeter guidance now to confirm which activities will require authorisation ahead of the September application window, since firms that delay preparation risk operating without authorisation once the regime takes effect.
