Senators will decide whether to terminate debate on the motion to proceed to the next stage of consideration, which requires 60 votes. If the vote passes, the bill will proceed to the full Senate for debate, amendments, and a final vote; this does not mean the bill will pass directly tonight, nor does it mean it will immediately take effect.


For the crypto industry, the significance of this vote lies in whether Washington is willing to establish a clearer federal regulatory framework for digital assets. To garner bipartisan support, Senate Republicans accepted 126 substantial changes proposed by Democrats in the final draft. The new text incorporates stricter ethical provisions, grants state attorneys general a clearer law enforcement role, empowers the Treasury Secretary to intervene in potential deposit outflows caused by payment-based stablecoins, and revises developer-related provisions to reduce the risk of decentralized infrastructure developers being identified as money transfer institutions.


However, the most intractable obstacle to the bill remains political rather than technical. Democrats worry that the Trump family's crypto business could create a conflict of interest, and some lawmakers want to add constraints such as asset stripping or blind trusts; moderate senators like Warner and Gallego still hope to push for more amendments. On the other hand, some Republican lawmakers are also under pressure from the banking industry, concerned that stablecoin accounts with yield attributes will divert community bank deposits. The 60-vote threshold means that if a minority of Democrats or Republicans do not support it, the procedural motion could be blocked.


The market had already entered a defensive stance. During the US stock market trading session prior to the vote, Bitcoin briefly fell below $77,000, a daily drop of nearly 3%; crypto-related stocks such as Strategy, Coinbase, Robinhood, and Circle generally weakened. Market expectations for the bill's passage within the year also fluctuated significantly, reflecting that funds still do not consider a legislative breakthrough a high-certainty event.


If the procedural vote surpasses the 60-vote threshold, the market will likely interpret it as a signal of a substantial breakthrough in US crypto legislation, potentially leading to a recovery in policy expectations for native crypto assets, trading platforms, and stablecoins. Conversely, if the vote fails, industry expectations will likely return to regulatory rule-making and case-by-case enforcement, potentially causing short-term risk premiums to continue rising. Tonight's focus is not on whether the Clarity Act will immediately become law, but on whether both parties in the US can demonstrate that a viable legislative path for crypto regulation still exists.
