Blockchain Association Fights Back As Sheriffs' Group Warns Clarity Act Would Shield Crypto Crime

The crypto industry's fight to pass the Digital Asset Market Clarity Act picked up a new front this week: law enforcement.

In a letter sent Monday to Senate Majority Leader John Thune and Minority Leader Chuck Schumer, the Blockchain Association pushed back on claims from the National Sheriffs' Association that the bill would make it harder to fight financial crime. The NSA — which represents more than 3,000 sheriffs and 10,000 public safety officials — argued in a letter last week that the Clarity Act's decentralized finance carve-outs were too broad, and singled out Section 10604, the Blockchain Regulatory Certainty Act provision that creates a safe harbor for non-custodial developers and clarifies they aren't money transmitters. The sheriffs' group wants that section deleted or narrowed.

The Blockchain Association's chief policy officer, Lindsay Fraser, told The Block the letter was about correcting the record ahead of an expected floor vote, arguing the bill preserves a clear line between financial intermediation and neutral software development, and pointing to a separate letter signed last month by 160 former law enforcement and national intelligence officials urging the Senate to advance the bill.

A decisive week, again

The dispute lands in what both sides agree is a make-or-break week. Blockhead reported last week that the Clarity Act had effectively been shelved until September , with Thune telling reporters he didn't expect a floor vote before the Senate's August recess given a backlog of nominations and a Russia sanctions bill ahead of it in the queue. On Monday, Thune told Bloomberg he still expects an initial procedural vote before senators leave Friday — though the underlying dispute that has stalled the bill for weeks remains open.

That dispute is the ethics provision restricting crypto conflicts of interest for the president and other federal officials, which Blockhead covered when a near-final draft first added a sunset clause tied to 2029 — a compromise Democratic co-sponsors immediately called insufficient. Seven Democrats who had been negotiating on the bill rejected an updated version outright last week.

Tuesday evening added two more data points on where sentiment is heading. Bitwise CIO Matt Hougan said publicly that crypto "will be fine" even if Clarity misses this window. Separately, tribal gaming regulators and a group of senators renewed a push to fold a prediction-markets provision into the bill — the kind of late addition that typically shows up when a bill's core text has stopped moving and interested parties start trying to attach riders before it goes dormant.

Why this matters beyond Washington

This is the fourth distinct obstacle Clarity has hit since the House passed it 294-134 in July 2025 — first a two-month stall over stablecoin yield, which Blockhead tracked when Senators Tillis and Alsobrooks broke that deadlock in March , then the ethics dispute, and now a law enforcement objection layered on top of an unresolved Democratic holdout. Each prior obstacle got resolved or partly resolved before the next one appeared. Whether that pattern holds again before Friday is the only question that matters this week — and it's the one institutions waiting on US market structure clarity, from custodians to exchanges, are watching most closely.
