CLARITY Act's Last Pre-Recess Window Narrows to a Single Ethics Clause

The Senate has roughly five legislative days left to bring the Digital Asset Market Clarity Act to a floor vote before its August recess. Prediction markets aren't optimistic: Polymarket puts the odds of 2026 passage at 33 to 37 percent, down sharply from above 80 percent in February, while Galaxy Research has lowered its own estimate to 30 percent.

The bill has already cleared its two biggest procedural hurdles. The House passed it 294-134 in July 2025, and the Senate Banking Committee advanced its version 15-9 in May 2026. Senate Republicans released a merged 616-page text on July 22, combining the Banking and Agriculture Committee drafts into a single bill.

What hasn't moved is the ethics dispute that has now stalled the bill twice. As Blockhead reported when the text landed, the updated draft puts the Department of Justice — not the SEC or CFTC — in sole charge of enforcing a ban on federal officials and their spouses issuing or sponsoring a digital asset for compensation while in office. Seven Democrats who'd been negotiating on the bill rejected the language as insufficient within a day of its release, and Senate Banking Ranking Member Elizabeth Warren issued a separate statement opposing it. The dispute traces back to whether DOJ enforcement adequately constrains President Trump's own crypto holdings.

Without Democratic support, the bill can't clear the Senate's 60-vote cloture threshold, and no cloture motion has been filed.

For custodians, prime brokers, and exchanges that have spent the past year building compliance programs around an assumed SEC/CFTC split, a missed window doesn't just delay a law. It leaves the SEC and CFTC's March 2026 joint interpretive guidance — a taxonomy covering 16 digital assets — as the only framework in place, and that guidance can be rescinded by a future administration without a congressional vote.

If the Senate misses this window, the next opportunity is September — with midterm politics compressing the calendar and narrowing the odds of comprehensive passage in this Congress.
